Oklahoma Truck Accident Guide

Truck accidents are some of the most devastating collisions on the road. Due to their massive size and weight, commercial trucks can cause severe injuries and extensive damage when involved in a crash. If you or a loved one has been in a truck accident in Oklahoma, understanding your rights and legal options is essential.

At Red Dirt Legal, we help truck accident victims navigate the legal process, fight for fair compensation, and ensure negligent parties are held accountable. This guide will walk you through what to do after a truck accident, how liability is determined, and what compensation may be available to you.

What to Do After a Truck Accident in Oklahoma

The moments following a truck accident can be overwhelming, but taking the right steps can significantly impact your ability to recover compensation.

Call 911 – Always report the accident to the police. A law enforcement report will serve as a critical piece of evidence when filing a claim.
Seek Medical Attention – Even if you don’t feel injured immediately, some injuries, like concussions or internal bleeding, may not show symptoms right away. A medical evaluation will help document any injuries related to the crash.
Gather Evidence – If possible, take photos and videos of the accident scene, including vehicle damage, road conditions, traffic signs, and any visible injuries. If there are witnesses, collect their contact information.
Avoid Speaking to Insurance Companies Alone – Trucking companies and their insurers often try to minimize payouts. Before providing a statement or accepting any settlement offer, consult a truck accident attorney who can protect your rights.
Contact a Truck Accident Lawyer – An experienced attorney can investigate the crash, determine liability, and negotiate on your behalf to ensure you receive the compensation you deserve.

Who Can Be Held Liable in a Truck Accident?

Unlike standard car accidents, liability in a truck accident case can involve multiple parties. Determining fault requires a thorough investigation, as trucking companies and insurance providers often attempt to shift blame.

The Truck Driver – If the driver was speeding, distracted, fatigued, or under the influence of drugs or alcohol, they may be held responsible.
The Trucking Company – Many trucking companies encourage tight deadlines, leading to driver fatigue and unsafe driving practices. They may also be liable if they fail to conduct proper background checks or routine maintenance.
Manufacturers – If a defective truck part (such as faulty brakes or tires) contributed to the accident, the manufacturer may be responsible.
Cargo Loaders – Overloaded or improperly secured cargo can cause a truck to become unstable, increasing the risk of a rollover or loss of control.

Because trucking companies have legal teams working to limit their liability, working with an attorney can help ensure all responsible parties are held accountable.

Compensation Available to Truck Accident Victims

Victims of truck accidents often face significant financial and emotional burdens. If someone else’s negligence caused the crash, you may be entitled to compensation, including:

Medical Expenses – Covers emergency care, surgeries, rehabilitation, prescriptions, and ongoing medical treatment.
Lost Wages – If your injuries prevent you from working, you can recover lost income and compensation for reduced future earning potential.
Pain and Suffering – Compensation for the physical pain and emotional distress caused by the accident.
Property Damage – Covers the cost of repairing or replacing your vehicle and any personal property damaged in the crash.
Wrongful Death – If you lost a loved one in a truck accident, surviving family members may be eligible for compensation for funeral costs, loss of financial support, and emotional suffering.

Oklahoma Truck Accident Laws and Deadlines

Oklahoma has specific laws governing truck accidents and personal injury claims. Understanding these rules is crucial when pursuing compensation.

Statute of Limitations

In Oklahoma, you generally have two years from the date of the truck accident to file a personal injury lawsuit. If you miss this deadline, you may lose your right to seek compensation.

Comparative Negligence Rule

Oklahoma follows a modified comparative negligence system. This means that if you are found partially responsible for the accident, your compensation may be reduced by your percentage of fault. However, if you are more than 50% at fault, you cannot recover damages.

Trucking Regulations

Truck drivers and companies must follow state and federal regulations, including:

Hours of Service Limits – Federal laws restrict how long a truck driver can be on the road to prevent fatigue-related accidents.
Weight and Load Limits – Trucks must adhere to weight restrictions to prevent rollovers and tire blowouts.
Regular Inspections and Maintenance – Trucking companies must ensure their vehicles are properly maintained and safe to operate.

Violations of these regulations can play a key role in proving negligence in a truck accident case.
