Car accidents rarely happen in a vacuum. In many cases, multiple drivers may share responsibility for a crash, which can complicate the process of seeking compensation. If you’ve been injured in a collision in Oklahoma City, understanding how comparative fault works under Oklahoma law can help you protect your rights and your recovery.
At Red Dirt Legal, we represent car accident victims throughout Oklahoma who are dealing with complex insurance disputes and shared liability. Whether your accident involved speeding, distracted driving, or failure to yield, we’ll help you understand how fault is determined and what that means for your claim.
What Is Comparative Fault?
Comparative fault is a legal doctrine used to divide responsibility between two or more parties involved in an accident. Under Oklahoma law, if you were partially at fault for the crash, you can still recover damages — as long as your share of the fault does not exceed 50%.
This system is known as modified comparative negligence. Your final compensation will be reduced in proportion to your percentage of fault. For example:
- If you are found 10% at fault and your damages total $100,000, you can still recover $90,000.
- If you are found 51% or more at fault, you cannot recover compensation at all.
This makes fault allocation an extremely important factor in any personal injury claim.
How Is Fault Determined in Oklahoma?
Fault is determined based on evidence from the scene of the accident, such as:
- Police reports
- Eyewitness statements
- Surveillance or dashcam footage
- Vehicle damage analysis
- Accident reconstruction experts
Insurance companies often conduct their own investigations and may try to assign you a higher percentage of fault to minimize their payout. This is one of the key reasons to work with a skilled attorney — we know how to challenge unfair assessments and build a case that reflects the true circumstances of the crash.
Common Examples of Shared Fault in Car Accidents
Many car accidents involve situations where more than one driver made a mistake. Some common examples of shared fault include:
- One driver was speeding, while the other failed to yield
- Both drivers were distracted
- A rear-end collision occurred, but the front driver had non-working brake lights
- An accident during merging, where both drivers misjudged the distance
In each of these situations, both parties may bear some responsibility, but that doesn’t mean you’re disqualified from pursuing compensation.
Why Comparative Fault Matters for Your Case
Understanding how comparative fault works is essential when pursuing a car accident claim in Oklahoma City. Insurance companies will use this rule to their advantage whenever possible. Without legal support, you could end up accepting a settlement that is far lower than what you’re entitled to receive.
Your attorney can gather the evidence needed to demonstrate that your actions were reasonable, that your fault was minimal, or that the other driver’s behavior was the primary cause of the crash. This can mean the difference between recovering the full amount of your damages and receiving nothing at all.
What Damages Can You Recover?
Even if you’re partially at fault, you may still be eligible to recover compensation for:
- Medical bills
- Lost wages
- Pain and suffering
- Vehicle repair or replacement costs
- Long-term disability or rehabilitation
A thorough case evaluation will help determine the full value of your claim and how comparative fault may affect your recovery.
When to Contact a Lawyer
If you’ve been told you share blame for an accident, don’t assume your case is over. In many cases, fault assessments are negotiable, and insurance companies are not always accurate or fair. A knowledgeable legal team can help uncover the facts and fight for the compensation you truly deserve.
